PR Becomes Citizen In Four Hours

Less than four hours after Malaysiakini reported that a permanent resident (PR) holding a red MyPR card had been registered as a new voter, she has apparently become a citizen.

She now has a blue Mykad, based on a check of the same online system of the National Registration Department (NRD) where her identification details are recorded.

A check of the NRD online verification system twice at 5.48pm yesterday and 11.30am today had shown that a person named Mismah was a PR holder who had collected her MyPR card (No. 640704715238), an identification card for PR.

When the same number was entered into the Election Commission (EC) online verification system, Mismah appeared as a newly-registered voter.

However, another check with the NRD system at 3pm returned a shocking result. The same Mismah has become a citizen who has collected her blue Mykad.

Her status on the EC online verification system remained the same as at 3pm. A newly-registered voter in the latest supplementary electoral roll draft which is now on display for public scrutiny.

Despite the fact that non-citizens cannot be registered as voters, she was registered in the Ijok state constituency and Kuala Selangor parliamentary constituency, which are respectively held by Selangor Menteri Besar Khalid from PKR and Dzulkelfy Ahmad from PAS.

It appeared that Mismah's is not an isolated case.

Federal Territory PAS has claimed to have encountered 52 such cases when filing complaints with the Federal Territory EC today about the supplementary electoral roll draft.

Titiwangsa PAS division secretary Hedzer Ibrahim, who went to the EC office with other party leaders, said the first check with the NRD online verification system from 9-10am today showed that the 52 were PR who had collected their red MyPR card.

However, when the PAS team conveyed the result to the Federal Territory EC officials about 3pm, the latter checked the NRD database and found the 52 names to be those of citizens.

Hedzer then instructed the party technician to check the NRD online system again and obtained the same surprising result.

Fortunately PAS had screen-captured the result accessed this morning and a copy was given to Malaysiakini.

The 52 voters are registered in six parliamentary constituencies in Kuala Lumpur that were won by the opposition in the last general election.

These are Lembah Pantai (6 voters), Bandar Tun Razak (1), Segambut (5), Titiwangsa (28), Batu (8) and Wangsa Maju (4).

Malaysiakini is attempting to seek comment from the NRD.

Voter Registration Procedures

According to election laws, the EC updates the electoral roll every three months with a quarterly supplementary electoral roll draft.

The names of all newly-registered voters, voters who have changed their residing addresses and voters who have been removed from the electoral roll are compiled in the supplementary electoral roll draft.

The roll is then displayed usually for one week for public scrutiny before it is gazetted and used in the next election.

During the display period, members of the public can raise their objection to the names listed in the supplementary electoral roll.

12 Muslims quizzed by Jais, given counselling

An unidentified woman, who turned up for an interview with Selangor Religious Department officials yesterday together with 11 others, before they were provided counselling by the Selangor Mufti Department.

SHAH ALAM: The 12 Muslims involved in the Damansara Utama Methodist Church (DUMC) saga early this month were yesterday questioned and given counselling at the Selangor Islamic Religious Department (Jais).

A source said the 12 were interviewed by Jais enforcement officers at 9.15am, before they were offered counselling by the Selangor Mufti Department.

As of late afternoon, counselling for some of those involved were still continuing.

It is learnt that Jais director Marzuki Husin and Deputy Selangor Mufti Datuk Abdul Majid Omar were among those present during the meeting.

Also present was a lawyer representing 10 of the 12.

Attempts to get comments from Marzuki on the case were unsuccessful as members of the media, who were waiting outside his office, were turned away by security personnel.

In a brief text message sent by the department's public relations deputy director Nurhamizah Othman, it was reiterated that Jais would only issue a statement once a full report was ready. It was not specified when it would be completed.

On Aug 3, a team of enforcement officers from Jais, assisted by policemen, inspected the DUMC following a tip-off that Muslims were present at a dinner event there.

DUMC said later the dinner had nothing religious in nature but was to celebrate the work of non-profit organisation Harapan Komuniti in helping women, children, HIV/AIDS sufferers and victims of natural disasters.

Following public outcry, Jais was asked to prepare a full report, detailing what actually transpired on that day, to be submitted to Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim, who would then seek the advice of the Sultan of Selangor.

12 Muslims in Church Give Evidence In IRAD

A total of 12 Muslims, who are in a church in Damansara Utama when the examination of the Selangor Islamic Religious Department (Jais) recently, come forward to give evidence and to receive counseling at the department's office building at the Sultan Idris Shah, on August 15, 2011.

A total of three men and nine women aged between 20's and 40's is seen arriving in stages from 9:15 am to 1 pm.

According to sources, they are given counseling in small groups between two and three by several officers Jais and Selangor Mufti Department.

"She is a single person. How can she allow a man into her room when they are not married? What's the status of the relationship?" said Mohamad Khir Toyo, the National Front ex-chief minister of Selangor.

Opposition officials said a decision would be made later on whether to accept the resignation, which would trigger a by-election in Selangor.

Ms Wong said she believed that the governing National Front coalition would "continue to manipulate the situation".

"Accordingly I have decided to make a stand in the interests of the party and its struggle for the people," she said, as a group of supporters holding flowers and banners yelled support.

She said it was "an insidious and under-handed attempt" to smear her reputation, adding that "the real objective is to discredit the party".

This is the latest incident in Malaysian politics to intrude into the private lives of politicians - most of whom have been opposition figures.

The September 20-23, 2010 issue of Harakah carried an interview with Prof. Dr. Abdul Aziz Bari, Professor of Law at International Islamic University, regarding implementing hudud (Islamic Criminal Law) in Malaysia. The interview focused on Karpal Singh's (MP for Bukit Gelugor, Penang and Chairman of Democratic Action Party) claim that Malaysia is a secular country. Excerpts of the interview are translated below:

Harakah: Recently, Professor reacted strongly to Karpal's statement that our country is secular. What's the link between being secular and implementing hudud in Malaysia?

Prof. Dr. Abdul Aziz Bari: The secular issue was raised as an excuse to block the implemention of hudud. In other words, this secular stand can be used as a filter to reject or accept something. This departs from regarding the Constitition as the highest law from which all other laws develop. According to this secular view, laws based on religion cannot be implemented.

Harakah: Is this claim true?

Prof. Dr. Abdul Aziz Bari: This claim is not true as Karpal based his opinion on the case of Che Omar bin Che Soh. This case was decided by the High Court -- before it was transfered to the Federal Court-- and presided by Tun Salleh Abas in 1988.

However, the case does not state that Malaysia is secular... It merely states that the Constitution is the highest law and maintains the dichotomy of secular laws. Anyway, the problem with this case is that the judges did not scrutinise the Reid Report and White Paper.

Harakah: What examples show that our country's Constitution is not secular?

Prof. Dr. Abdul Aziz Bari: The clearest example is Article 3(1) of the Federal Constitution which states, amongst other things, that "Islam is the religion of the Federation", which places Islam as the "faith" or "religion" of the country.

Harakah: How about those who say that Article 3(1) needs to be interpreted with reference to the admission by our former Prime Minister Tunku Abdul Rahman that Article 3(1) does not affect the secularity of our country?

Prof. Dr. Abdul Aziz Bari: There're several ways to refute this argument. First, we're not sure whether Tunku understood the meaning of secular country. If we recall what Tunku did - like forming the Religious Department of the Prime Minister's Office now called JAKIM -- it's clear he said one thing, did another.

A secular country cannot make provisions to build mosques, employ imam and mufti, build religious school and other things. This is because this privilege is not given to other religions and this is not fair.

Second, Article 3(1) is clear enough and without any doubt. So why do we need to refer to the thoughts or statements of Tunku or the Reid Commmssion Report?

Harakah: Another argument .. is that the Constitution has an original structure that cannot be changed even with the approval of two-third majority in Parliament. Please explain, Professor.

Prof. Dr. Abdul Aziz Bari: From the research I've done, there's no need to change the Constitution to implement hudud...

Harakah: Looks like there is no obstacle to implementing hudud?

Prof. Dr. Abdul Aziz Bari: Yes, to me, it only requires Parliament or a State Assembly to approve an Act or Enactment for the provision of offences and punishment under hudud.

Harakah: Recently, Professor was quoted by the media as having said that hudud cannot be implemented through a classical approach?

When you do wrong it does not matter who you are. UMNO, MCA, MIC or Pakatan Rakyat. When you do wrong then you are wrong! When you lie then you are a liar. And when you profess to be a Muslim you do not fornicate outside marriage and sodomy is a sin! So for those of you who are die hard supporters of Najib or Anwar, of Pakatan Rakyat or Barisan Nasional, you must step back and listen to your heart. Listen to that beating heart, put your hand on that beating heart and ask yourself what does our country and our people need?

Do our country and people need a change in Government? Do we need a Najib or an Anwar to be our Prime Minister? Does our country need Pakatan Rakyat to be in power?

What our country needs are decent, responsible and honest leaders who will govern our country in our interest. Not theirs. Find these leaders and we will find our way out of this mess that our country is now in.

Where do we look for these leaders? From within Barisan Nasional or from within Pakatan Rakyat? Certainly none of the first tier leaders from within both political divide in our country can meet our aspirations of the leader we want. We are prepared to close one eye and shut the other … read that again … close one eye and shut the other … and in so doing we get Mahathir, Najib, Muhyiddin, that Din guy and Anwar to be in position to claim that they are our leaders. They claim that they are our leaders … we do not claim that they are … at least I do not!

So how has it come to this? How is it that we have a Mahathir that has ruled us for over 3 decades, an Anwar that has been sacked as DPM and has endured sodomy one and is now embroiled in sodomy two and do not forget this Najib too. Najib who has yet to explain to us his involvement in the Altantuya murder and the waste of billions of ringgit of the people's money while he was Minister of Defense? How has it come to pass that these are the people who are currently jostling for a position within the first tier of Malaysian politics? Why is there no Tun Razak, no Hussein Onn, no Tan Chee Koon and no Sambathan (to name a few)?

These people are not around today because we are now prepared to accept less. Our leaders offer bribes to voters to vote for them. We tell ourselves that that is the way of Malaysian politics! Our leaders declare that they will take over the government on such and such a date and when that date passes without anything happening … we excuse his bluff as being part and parcel of Malaysian politics. And yet we fail to blame ourselves for the half past six leaders that we now have right in the first tier of our political parties!

We make Malaysian politics the way it has now become. Corrupt, sleazy, always a "me first" power at all costs abyss of human beings whom we would not want our son or daughter to take as their partners in life!

So where to now? I have made my mistakes too and I would be the first to say these are mistakes that must be corrected. I have begun the process, within myself, to question my stand on a number of issues. I, me and myself will now try to subjugate what are partisan interests and instead put the greater interests of country and our people first. It starts today

If you are a regular Malaysiakini you may notice one thing. The top leadership of PKR (Partai Keadilan Rakyat) keeps saying that they will eventually form a government by September 16 this year.

It is said that “10 Sarawak BN parliamentarians were ‘hijacked’ and sent to Beijing on such a visit.” And two of them are supposed to make an important announcement.

Mmm… I wonder what exactly is that announcement supposed to be…

Now, Malaysiakini has published a lot of articles of the top leadership of PKR (Partai Keadilan Rakyat) making statements that they will form a govt in the near future.

Sometimes I wonder whether this is possible. This is because the odds are soo much against PKR and PR (Pakatan Rakyat). The incumbent UMNO led BN (Barisan Nasional) has so many advantages despite their extreme unpopularity in the afternath of their decision to lift fuel prices.

Now, Malaysiakini has published some analysis reports about this situation. Well I am not going to review it here…

Sometimes I also wonder whether it is desirable for PKR and the PR to wrest govt control via defections in the Parliament. Pakatan Rakyat’s plan to take over via defections may have serious a repercussion. It may change the “rules of the game” in the Malaysian political scene. It will “legitimise” mass defections. Now, some readers may not agree with me. They may say that yes, we need a new govt fast and so on and so forth. And I suppose I need to explain what do I mean by changing the “rules of the game”. Unfortunately such an explanation is rather tedious and “too” complicated to be put into one blog posting. Now, since today is Saturday. Why not make this a “fun posting”?

And so….What happens when it gets too hot? The situation in Malaysia is hot… definitely… I am sure many people are anxious to wait what will happen on Monday…
